You have time to continue to work on your mock trial and closing argument preparations. Use class time wisely - big busy week coming up! You will want to get the bulk of your work done by Tuesday - scripting / writing closing arguments. This way you can use Wed double blocks to rehearse and make sure you have your props and things all ready.

Lees' Law 12 @ FH
Welcome Fraser Heights Law 12 students! This blog will serve several purposes: provide a forum for students to share ideas, questions, and comments to supplement class discussions and support each other throughout the course (collaboration skills). If you have ideas / issues or articles in the news you would like to consider for future topics please send them to me as a suggestion and I will do my best to incorporate them - this way our blogging will be less mine, and more ours!!!

Civil Cases and Mock Trials:
As we discussed in class, the class has been working very hard and doing very well this term. As a result, if this continues, there may be an opportunity to not have a final assessment at the end of term - completely dependent on attendance, work habits in class and the quality of the work being done on your final term assignments. If not satisfactory, expect to have a final assignment worth 20 % of your final grade at the end of term (using the skills taught throughout the term).
Tort Law:
You have a selection of case studies to choose from: Civil Cases
You may choose 1 Level One Case or 2 Level Two cases to complete. Choose whichever will showcase your abilities the best.
Level One: more complex and challenging cases
We reviewed and introduced the cases in class with tips. Reminder, you will have class time to work on these and you may discuss and seek help from peers and myself while working on the cases, but your final case study arguments need to be written by you individually. Your words will be different from your peers, or mine and should be.
What do you need to do?
Case Analysis: break down the essential elements and evidence to support each side's case. Put on your legal advocate "hat" or step into your "lawyer shoes" (whichever analogy works for you) and be ready to Discuss the Plaintiff's case and the Defendant's case. This part of the analysis may be done in chart form or paragraphs.
Then: assume your "Judge's Robes" and pass judgement on the case. Who wins? Remember to use civil language (Who do you find liable and why? What grounds sway your decision? How much liability do you award - if you decide partial liability is to be accepted by both parties)
Assessment: Like the family law cases, and other examples (your criminal fairy tale presentations), I am looking for your ability to apply/use the legal language appropriately and support with reasoning/logic and evidence from the case details.
Mock Trials:
As discussed in class, you have a few decisions to make on Wednesday next week. Wednesday you will commit. (PS While I reserve veto power, you also accept responsibility for your decision.)
First:
1. Will you be participating in a mock trial performance? (6-8 people required).
2. Will you choose the paired closing argument option?
3. Will you choose the individual closing argument option?
Second:
Decide which case you will do? Be ready to tell me and commit by Friday.
1. One of the civil cases?
2. Fairy Tale
3. Case from the unscripted options available on the Justice Education site. See link in the right sidebar. Go to resources and mock trial scripts.
***The scripted cases may be samples and guides to demonstrate language, questioning and protocol but you must create your own - you are seniors (soon to be adults!!!)***
Assessment: See Mock Trial Rubric or the Fairy Tale Closing Argument Rubric
*Closing arguments will not have the court protocol or questioning elements apply to their arguments.*
When will you perform? The week after Grad - June 8, 9, 10
This leaves the last few blocks for any last missing assignments or a final assessment in class if necessary - if the Civil unit assignments, attendance and attention in class are not consistent and satisfactory overall.
Your final Law 12 Unit! Civil Law and Torts (Unintentional and Intentional)
You have a selection of case studies to choose from: Civil Cases
You may choose 1 Level One Case or 2 Level Two cases to complete. Choose whichever will showcase your abilities the best.
Level One: more complex and challenging cases
- Jacobsen vs Nike
- Gibbs vs Jalbert
- Hollis vs Dow Corning
Level Two: more straight forward cases
- OPSEU vs Ontario Government
- Jeffrey vs Commodore Ballroom
- ter Neuzen vs Korn
We reviewed and introduced the cases in class with tips. Reminder, you will have class time to work on these and you may discuss and seek help from peers and myself while working on the cases, but your final case study arguments need to be written by you individually. Help Please! Use your networks to spread the word to ask peers to read blog for field trip
Reminders for May 19-22
Monday - Holiday!
Tuesday -
FIELD TRIP ALERT: Must bring your field trip forms!!! If we do not have enough people (26 of 29), then we cannot afford to pay for the bus to go and I will need to cancel the bus and the trip :(
THIS IS WHY I NEED YOUR NETWORKED HELP GR 12s!
You will have a TOC, Ms. Saltel, on Tuesday as I will be at a District Humanities Dept Head meeting all day, but I will return after school to ensure we have enough forms to attend our field trip. If you know for sure you are unable to attend, please email me. I only know of Devon so far. Reminder - you should not miss any other classes, that day as we will return by 12:00 pm. I will also be asking Ms Saltel to email me of the numbers in case I need to cancel the bus at lunch. Forms are of first priority, money can be collected Wednesday if forgotten. Additionally, if you were absent on Friday or Tuesday during handing out of forms or collecting them, please email me with your intentions and I will do my best (eg. Jordan was going to be away on Tuesday - please email me if you plan to attend or not on Wednesday).
In class, you will have time to finish off your Family Law assignment (extra handouts and field trip forms will be available for those who were absent). You will also need to read ahead to be prepared for your next cases in Tort Law. To do this please read up on the chapter with Intentional and Unintentional torts. Additionally, I think I still have notes posted in the sidebar if you are without a text book. I am not asking you to make notes but I do need you to read them and be familiar with them for your next cases / mock trials.
Assignment 1: (In class) Custody Assignment - paired assignment
Intentions - to show (specifically state) the pros and cons for all custody options - to demonstrate your understanding of how custody is determined (best interests of the child, to demonstrate your application of reasoning skills and application of legal language/terminology in your final judgement - basically being able to use the family related legal language appropriately and effectively).

- sole - both with mom
- sole - both with dad
- sole - boy with dad, girl with mom
- sole - boy with mom, girl with dad
- joint physical custody - 50/50 sharing of physical and legal decisions 9medical, educational,...)
- joint legal custody but physical custody with mom
- joint legal custody but physical custody with dad
- joint legal custody but physical custody is split (like options 3 or 4)
- others?
Finally - make a joint decision and justify your custody arrangement.
Assignment 2: You were given 2 riso handouts with 5 or 6 family law cases
Mandatory cases: Murdoch vs Murdoch and Petkus vs Betker
Then choose 1 other case based on your interest or to best demonstrate your understanding of the case - if you do not understand the case, don't choose it. Please give your case the appropriate title eg. Zedner vs Zedner
Expectations - each case has their own questions to be answered in full sentences/ small paragraphs if necessary. Yes - in gr 11/12 I expect to be able to understand the question being asked from your response, have not pronoun confusion (he's and she's) and your responses should be written on separate paper). Use and apply legal language where possible.
Otherwise - I really hope you are enjoying your long weekend :) Only 4 weeks and 3 days to go till the end of classes, ... oh my !

Family Law Introduction
Class attendance Alert: many have recently been absent and late to class (abnormally high number!) Absences - as long as excused - no problems. Do remember to attend flex during that week to make up work missed. Please reign this in (particularly tardiness). Tardiness is starting to get to the point of being very disrespectful to peers and myself.
Flex Time: this week it will be Wednesday and maybe Friday (Other commitments Monday, Tuesday, and Thursday for sure - maybe Friday)
Reminder we will be going on a field trip next Wednesday and forms will be available as soon as I get a bus booked.
Monday: Introduction to Family Law (*this will be a quick unit of 1 week!)
(marriage, ending a marriage, children and other issues related)
First: Students - created a 3 column chart with headings marriage, divorce and other.
Then they brainstormed questions and/or things they thought they knew but were not sure and want to confirm about marriage, divorce and other family related concerns (eg. same sex marriages, common law, adoption,...) - I collected these. Why? To pre-assess class knowledge and also to inform where I should spend more time teaching based on student interest.
Second: some discussion around a current events family law / ethical issue regarding fertility treatments and a radio contest.
Third: notes - Marriage (essential requirements) can be found in Chapter 13
Homework: Read chapter 13 up to and including section 13.4 so that you are prepared for activities with the TOC tomorrow. They will be collected at the end of the class.
Tuesday: TOC Ms Hoffer
You will have some in class tasks to complete and hand in at the end of the block.
Wednesday - continue with Family Law
Friday: Continue with Family Law

Absent Tuesday - sorry
Hi everyone,
Sorry I will be home sick again on Tuesday. Your TOC said you were all so awesome today - worked well and were very welcoming and respectful. That was great to hear as I am home sick. Thank you! Keep it up for Tuesday.
This means - the TOC may open for flex but might not.
You will be continuing with your civil law introduction.
Hope to be back by Wednesday, but keep up the good work!
